Rand Paul, who had publicly wavered as to whether he would support Supreme Court nominee Brett Kavanaugh, says he has made a decision to endorse him, despite misgivings about the judge's views on surveillance and privacy issues.

Manchin was one of three Democrats who voted to confirm Trump's first supreme court pick, Neil Gorsuch.

In the most recent HuffPost/YouGov survey, a third of Americans say that the Supreme Court will be very important to their vote in the midterms.

Although he was initially teetering on the brink of voting to confirm Kavanaugh, Paul had said Kavanaugh "may be a lot better than a Clinton appointee"- in this case, Justice Ruth Bader Ginsburg.

Trump nominated Kavanaugh to the high court earlier this month, after Justice Anthony Kennedy announced his retirement. With the Senate control slimly held by Republicans 51-49, Democrats can't block Kavanaugh's nomination outright if Republicans hold together.

West Virginia Attorney General Patrick Morrisey, who is running against Manchin for Senate, said in a statement before the meeting the senator needs to stop "waffling".

Of course, my vote is not a single-issue vote, and much of my reading and conversation has been in trying to figure out exactly how good Judge Kavanaugh will be on other issues before the Court. Most other Senate Democrats, including Democratic leader Chuck Schumer, have delayed seeing Kavanaugh as they demand release of documents from Kavanaugh's past, including from while he worked in the White House of President George W. Bush. Democrats say that time is relevant to Kavanaugh's views and philosophy as a judge.

Senate Judiciary Committee Chairman Charles E. Grassley (R-Iowa) has asked the archives exclusively for Kavanaugh's documents from his time in the counsel's office because Republicans believe the paperwork from Kavanaugh's time as staff secretary is irrelevant to how he would serve as a justice.

Manchin is one of ten Senate Democrats up for re-election in a state President Trump won in 2016. In a 2015 opinion, Kavanaugh backed the constitutionality of the National Security Agency's warrantless surveillance program, a ruling that civil libertarians opposed.
