Among other objectives, the project aims for a unique Aadhaar number, tied to an individual's iris scan and fingerprints, to help block theft and leakages in India's $23.6-billion-a-year food welfare programme.

The Court has struck down the Sections 33 (2), 47 & 57 Of the Aadhaar Act.

Advocates say it has granted hundreds of millions of Indians a unique identity document in a country where only 58% of births are registered. However, it struck down certain provisions of the Aadhaar Act.

The Supreme Court verdict on Aadhaar is a balanced and appropriate judgement, which offers positive takeaways for both Aadhaar supporters and detractors. The fifth judge - Justice Dhananjaya Y Chandrachud - however, said that Aadhaar is wholly unconstitutional.

"The Congress-led UPA's vision of Aadhaar was always voluntary and never mandatory", the statement added.

He was quick to wave aside concerns of any information leaks, stating that "Aadhaar in itself doesn't pose any privacy issue because it's just a bio ID verification scheme". In March of 2014, the SC directed the Centre to withdraw any instructions which made Aadhaar mandatory.

The court has also ruled that the UIDAI can not retain authentication records for five years.

Government lawyers disputed claims that privacy was at stake, arguing that the data was kept in "silos" - so a bank would never know if you had claimed your monthly ration or filed your taxes.

In a much-awaited judgement, the Supreme Court today declared that Aadhaar is constitutionally valid, but it is not mandatory for all services.

Justice Sikri struck down Section 57 of Act permitting private entities like telecom companies or other corporates to avail Aadhaar data.

He had some strong words for the Executive for the passage of the Aadhaar Act as a Money Bill, terming it a "fraud on the Constitution" and a subterfuge.

Maintaining that the Prevention of Money Laundering Act Rules proceeded on assumption that every bank account holder is a money launderer, he said the assumption that every individual who opens a bank account is a potential terrorist or a launderer is "draconian", he said.

The court added, though, that enrolment of children can only be done with parental consent, and added that they should be given an option to exit on attaining majority.

The bench said attack on Aadhaar by petitioners is based on violation of rights under the Constitution, will lead to a surveillance State. The Aadhar authentication data can not be stored for more than six months, it added.

The Supreme Court later clarified that it had never given any such order.

In 2013, an apex court bench passed an interim order stating that the UID number can not be made mandatory for gas connections, vehicle registration, scholarships, marriage registration, salaries and provident fund.
