According to the US Financial Regulator, the announcement made by Elon Musk to take the electric carmaker firm into privatization was false.

US District Court Judge Alison Nathan asked on Thursday that both Musk and the SEC supply justification for the settlement reached over the Tesla privatisation fiasco.

The tweets come days after Musk agreed to relinquish his Tesla chairmanship for at least three years and pay a $20 million fine.

Musk renamed the SEC in a tweet as the Shortseller Enrichment Commission.

The SEC charged Musk with misleading investors with the tweet, saying it had no basis in fact.

Also among the settlement's provisions: Tesla must set up a committee to review Musk's communications directed at investors, including his posts on Twitter and other social media. "And the name change is so on point!" he said on Twitter.

The tweet came less than four hours after U.S. District Judge Alison Nathan in Manhattan ordered Musk and the SEC to explain by October 11 in a joint letter why their settlement was fair and reasonable and would not hurt the public interest.

Shares of Tesla closed down 4.4 percent at $281.83, and fell another 2.2 percent after market hours following Musk's tweet.

Nathan "may want to know why Tesla is paying a fine because the CEO doesn't know when to shut up", said Adam Pritchard, a University of MI law professor and former SEC lawyer.

Musk's dispute with the SEC originated on August 7, when Musk said he was considering taking Tesla private at $420 a share, and that he had already secured the funding.

Tesla has consistently been one of the most-shorted USA stocks as many investors continue to bet on declines in share prices.

But the settlement still needs court approval.

Greenlight is having a hard year, with its main fund down 25.7 percent through September, but said its Tesla short position was its second biggest victor in the third quarter.

"I have lost 30 years of my life savings all in $tsla thanks to your tweets please stop", TrendTrader007 wrote.

Musk also dragged BlackRock into his long-running dispute with short sellers, alleging the fund manager was reaping heavy profits by lending shares they hold to this group of investors.
